Residence permit for working on self-employed basis

Migrant who fall under this category are persons who wish to come to the Netherlands to work as an independent entrepreneur, or who wish to work on self-employed basis in professions such as doctor, physiotherapist, artist or sports instructor.

Just as with residents permits for the purpose of working in employment the residence permit for the self-employed is issued only if there is Dutch interest served.

For the answer to the question whether a Dutch interest is served by the issuance of the residence permit the advice from one the ministries will in many cases be decisive.

In applications where the applicant wishes to start as an independent entrepreneur or to practice a profession on self employed basis a advice from the Ministry of Economic  

Affaires will be required. In instances where the applicant wishes to come to the Netherlands to be an artist the Ministry of Education and Cultural Affaires will be advised. If the applicant intends to come to the Netherlands to be a sports instructor the Ministry of Public Health will asked for an advice.

To make it more accessable for highly skilled knowledge workers to settle in theNetherlands as an indepenent entrepreneur a point system has come into force as of January first 2008 which forms the basis of the advice to the IND in order to determine whether of not the business activity of the applicant serves a Dutch economic interest.
 
Points are given for three categories: the education and de economic position of the applicant up until now, the motivation of the plans and ideas in the business plan, and the contribution given to the Netherlands with the economic activity in the form of innovation, employment and investment.

For these three categories there are a total of 300 points to be given. For a positive advice the applicant must at least obtain 30 points for each category (in total 90 points).
